Expat Tax Planning in the UAE 2026: Residency, Corporate Tax, Home Country

Expat Tax Planning in the UAE 2026 Residency, Corporate Tax, Home Country

Table of Contents

The UAE is known for tax-free salaries, but that does not mean every source of income is tax-free. Expats may still have tax duties in their home country. Those running a business may also need to follow UAE Corporate Tax and VAT rules.

Good expat tax planning helps you understand the rules, use available treaty relief and keep the right records. At Dubai Business & Tax Advisors, our ACCA-qualified team helps expats review these obligations. This UAE tax guide for expats explains the key rules in practical terms.

What Is Expat Tax Planning in the UAE?

Expat tax planning in the UAE means understanding where your income may be taxed, what relief is available and which returns you need to file. Start with 3 things:

  • Tax residency: Helps identify where you may be treated as resident and how applicable treaties allocate taxing rights.
  • Income type: Salary, personal investments, business profits and rent may follow different rules.
  • Home country rules: Your former country may still tax certain income, and some countries tax citizens on worldwide income.

This UAE Tax Guide for Expats is based on official guidance available in 2026. The right treatment still depends on your circumstances and the relevant tax treaty.

What Is Expat Tax Planning in the UAE

Is the UAE Really Tax-Free for Expats?

For salary, generally yes. The UAE does not impose personal income tax on employment pay. But you must still check business taxes, VAT and any tax you owe abroad.

Here is how the main taxes affect you:

Tax Does it apply to you? Rate
Tax on salary No 0%
Corporate tax If you carry on taxable business activity Generally, 0% up to AED 375,000 taxable income; 9% above
VAT On many taxable supplies and purchases 5%
Home-country tax Maybe Depends on your country

Do Expats Pay Tax on Salary in the UAE?

No UAE personal income tax applies to wages and salaries. Personal investment income and real estate investment income are generally outside UAE Corporate Tax when they meet the relevant conditions. Running a business is different.

Income type Typical UAE treatment in 2026
Salary No UAE personal income tax
Personal investments Generally not subject to Corporate Tax
Individual UAE business turnover up to AED 1m Generally, outside Corporate Tax scope
Individual UAE business turnover above AED 1m Corporate Tax applies to taxable income
UAE company business income Generally, within Corporate Tax scope regardless of AED 1m threshold
VAT on taxable supplies 5% standard rate; registration rules apply

How Do the UAE Tax Residency Rules 2026 Work?

The domestic rules are set out in Cabinet Decision No. 85 of 2022, effective from 1 March 2023. An individual can qualify under any one of 3 routes.

Test What you need
Days in the UAE 183 days or more within 12 consecutive months
Days plus ties 90+ days plus UAE/GCC nationality or valid UAE residence permit, and a permanent home or work/business in the UAE
Life centre Your usual or primary home AND centre of financial and personal interests are in the UAE

What Is the UAE Tax Residency 183 Days Rule?

The 183-day test is a clear route to UAE tax residency. Days need not be consecutive, and part of the day counts. A residence visa alone is not proof of tax residency. The 90-day route has extra conditions. A tax treaty may use a different test, so plan your move around both countries’ rules.

What Is a UAE Tax Residency Certificate and Why Do You Need One?

A Tax Residency Certificate (TRC) is issued by the Federal Tax Authority (FTA) as evidence of UAE tax residency for a specified period. You may need it for treaty claims or a foreign tax filing. The UAE has signed more than 140 double taxation agreements. A TRC can cover an eligible current or past period, but not a period that has not started.

How to Get a UAE Tax Residency Certificate: 5 Simple Steps

  1. Log in to EmaraTax or create an account.
  1. Choose “Other services”, open “Tax Residency Certificate” and select the certificate type.
  1. Enter the period and upload the documents required for your circumstances.
  1. Pay the AED 50 submission fee and the applicable certificate review fee.
  1. Submit your application and download the certificate once the FTA approves it.

For an electronic TRC, the fee is AED 500 if you have a Corporate Tax TRN, AED 1,000 for an individual without one, or AED 1,750 for a company without one. A hard copy costs AED 250 extra. The FTA states 10 business days for a complete TRC application.

Common supporting documents include:

  • Your entry and exit report
  • Your lease and utility bills
  • Your salary slips and bank statements

Do Expats Pay UAE Corporate Tax?

Not on employment salary. Corporate Tax applies to taxable business income. Here are 6 points to check:

  • Employment wages are not subject to UAE Corporate Tax.
  • A natural person conducting business in the UAE generally enters the Corporate Tax regime when business turnover exceeds AED 1 million in a calendar year. Companies follow separate rules.
  • Under the ordinary regime, taxable income up to AED 375,000 is subject to 0% tax; the amount above that is generally taxed at 9%.
  • Eligible resident businesses may elect Small Business Relief if revenue does not exceed AED 3 million in the current and all earlier relevant tax periods. The relief applies to tax periods ending by 31 December 2029.
  • For UAE-resident businesses, VAT registration is generally mandatory if taxable supplies and imports exceeded AED 375,000 in the past 12 months or are expected to exceed this in the next 30 days. Voluntary registration may be possible above AED 187,500.
  • Qualifying multinational groups with consolidated revenue of at least EUR 750 million may face the UAE’s 15% minimum top-up tax. Most individual expats are unaffected.

Do Expats Pay Personal Income Tax in the UAE in 2026?

No. The UAE does not charge personal income tax on salaries or wages. This is why many people call it a tax-free salary UAE destination. Your employer does not deduct income tax from your monthly pay.

You generally pay no UAE personal income tax on the following income. However, income from a business activity may be subject to Corporate Tax:

  • Salary and employment income
  • Freelance or consultancy income (Corporate Tax may apply to business activity)
  • Personal real estate investment income (subject to the relevant conditions)
  • Personal dividends and interest income
  • Capital gains from personal investments

The UAE also has no general federal wealth tax or inheritance tax. Home-country tax and local transaction charges may still need to be considered.

Tax-free salary does not mean tax-free business. You may pay 5% VAT on taxable purchases, owe tax in your home country, or need to register for UAE Corporate Tax or VAT.

How Does UAE Federal Tax Authority Registration Work?

Businesses and individuals within the Corporate Tax rules generally register through EmaraTax. Registration and filing deadlines vary for companies, residents and non-residents. Our corporate tax team can confirm the applicable requirements.

Task Deadline Late penalty
Resident natural person: UAE business turnover above AED 1m 31 March of following calendar year AED 10,000
File Corporate Tax return and pay tax Usually within 9 months of tax period end AED 500/month initially; AED 1,000/month from month 13 (for late filing)

Can Expats Become UAE Tax Residents After 90 Days?

Yes, in some cases. You need at least 90 days in the UAE within 12 consecutive months and must be a UAE or GCC national or hold a valid UAE residence permit. You must also have a permanent place of residence in the UAE, or carry on employment or business there.

You may instead meet the test where both your usual or primary residence and your centre of financial and personal interests are in the UAE. Your home, family, work, and economic ties can matter.

What Is the Difference Between a UAE Visa and Tax Residency?

A residence visa and tax residency are related but different. An immigration permission does not automatically settle your tax position or authorise every form of work.

Item UAE Residence Visa UAE Tax Residency
Main purpose Permits UAE residence subject to visa conditions; work may need separate permission Recognises UAE tax-resident status under applicable rules
Issued by Immigration authorities Determined under UAE tax rules
Based on Visa category and sponsorship Days spent and personal or work ties
Needed for Residence and related services; work subject to permission Treaty claims and foreign tax assessments, where relevant
Proof document Residence visa and Emirates ID FTA Tax Residency Certificate, where required

A visa alone does not determine your tax residence. A UAE tax residency certificate may help demonstrate your status to foreign authorities, subject to the applicable treaty.

Do Free Zone Companies Still Get 0% Tax in 2026?

Not automatically. A free zone company must qualify as a Qualifying Free Zone Person (QFZP) to receive 0% Corporate Tax on Qualifying Income. Check these key conditions:

  • Qualifying income: Income from certain free zone transactions and qualifying activities, subject to exclusions and other conditions.
  • Real substance: Adequate operations and resources in a free zone, including necessary staff, assets and expenditure.
  • Small non-qualifying income: Non-qualifying revenue must generally stay within the lower of 5% of total revenue or AED 5 million, with statutory exclusions.

Other income may face 9% Corporate Tax, and failing QFZP conditions can remove the preferential regime for the current tax period and the next four. Free zone companies must still register and file. Our free zone company setup team can review your position before you sign a licence.

What Documents Are Needed for a UAE Tax Residency Certificate?

Documents depend on the residency route and whether you need the certificate under a double tax treaty. The FTA may request extra evidence.

If you spent 183 days or more in the UAE, you would generally need:

  • An Emirates ID or passport, as applicable
  • An official UAE entry and exit report
  • Other supporting records if requested by the FTA

For the 90-to-182-day route, you will generally also need:

  • A valid Emirates ID, passport and official entry and exit report
  • Evidence of UAE employment or business activity, or a permanent home
  • For the primary-home and centre-of-interests route, proof of your UAE home and financial and personal ties

Apply through the FTA’s EmaraTax Tax Residency Certificate service. Check out the treaty requirements and allow time for the FTA to review your evidence.

Do UAE Residents Still Need to Pay Tax in Their Home Country?

Sometimes, yes. Moving to Dubai does not automatically end your tax duties elsewhere. Each country has its own residence, source-of-income and reporting rules.

Review these duties before moving, and again when you prepare your first tax returns after leaving.

UK Expat Tax UAE: How Do You Become Non-Resident?

HMRC uses the Statutory Residence Test for each UK tax year. One automatic overseas test applies if you were a UK resident in at least one of the previous 3 tax years and spend fewer than 16 days in the UK.

Another applies if you were not a UK resident in any of those 3 years and spend fewer than 46 UK days. Full-time overseas work may also qualify if you spend fewer than 91 UK days, work more than 3 hours in the UK on fewer than 31 days, meet the overseas hours test and have no significant break. UK ties and split-year rules can still matter. The UK and UAE have a tax treaty.

What Do Indian NRIs Need to Know?

Indian NRI tax rules in the UAE depend on the tax-year day count and other conditions. Under the Income-tax Act, 2025, the general tests include 182 days in India, or 60 days in that tax year plus 365 days in the preceding 4 years. Special rules apply to Indian citizens leaving for work abroad and to Indian citizens or persons of Indian origin visiting India. For certain visitors with Indian-source or other non-foreign-source income above ₹15 lakh, the 60-day condition becomes 120 days. A deemed-residence rule may apply to some Indian citizens with such income above ₹15 lakh who are not liable to tax elsewhere because of residence or similar criteria. Check your facts carefully.

What Mistakes Do Expats Make with UAE Tax?

  • Thinking a visa equals tax residency.
  • Skipping home-country filings because UAE salaries are tax-free.
  • Missing the 31 March registration deadline when it applies to a natural person’s UAE business.
  • Assuming every free zone company automatically receives 0% Corporate Tax.

How Does UAE Corporate Tax Affect Expats Who Own a Business?

UAE Corporate Tax generally applies to financial years starting on or after 1 June 2023. Natural persons conducting a UAE business can also be in scope, with 2024 as their first potential calendar-year tax period. Under the ordinary regime, taxable income up to AED 375,000 is taxed at 0%, with 9% on the excess. A qualifying free zone business may have a different treatment.

Taxable income / category UAE corporate tax rate
First AED 375,000 (ordinary regime) 0%
Above AED 375,000 (ordinary regime) 9% on the excess
Qualifying free zone income 0% if QFZP conditions are met

Frequently Asked Questions

UAE tax residency can help support treaty claims and establish your position with overseas tax authorities. It does not automatically remove foreign taxes or filing requirements.

You may qualify after at least 183 days in a consecutive 12-month period, or after 90 days if you meet additional citizenship, permit and UAE home or work conditions. The usual-home and centre-of-interests route can also apply.

Late registration or filing may trigger administrative penalties. Late tax payment can attract further charges. Submit overdue filings and settle outstanding liabilities as soon as possible.
